A legal opinion by Günther, a law firm specializing in environmental law, examined the role of hydrogen in the context of heat planning. The authors came to the conclusion that a responsible designation of areas in which the future heat supply is to be provided by hydrogen is subject to high hurdles.

The focus of the report was on the discretionary and/or assessment scope of the municipalities as the bodies responsible for heat planning. In particular, the "whether" and "how" of designating hydrogen network areas was examined and discussed.
